Terms of service

1. Who you contract with

pescaday.com, the Pescaday app and the paid tiers Plus and Perfect Drill are provided by Pescaday, a sole proprietorship of Finn Göpfert, c/o IP-Management #12373, Ludwig-Erhard-Str. 18, 20459 Hamburg (“we”), e-mail hallo@pescaday.com. By using Pescaday you agree to these terms.

2. What we offer

Start is free. Plus and Perfect Drill extend the fishing desk with more spots, bite alarms, target fish and trips, see Pricing. Bite times and forecasts are estimates and do not guarantee a catch. Rules such as closed seasons and size limits are shown with sources but without warranty; the official texts and your permit apply.

3. Ordering through Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle (Paddle.com Market Limited, 30 Old Bailey, London EC4M 7AU, United Kingdom) handles checkout, payment, invoices, taxes, cancellations and refunds; the Paddle Buyer Terms also apply. Prices include VAT or sales tax where applicable.

4. Subscription, renewal and cancellation

Plus and Perfect Drill are billed monthly or yearly in advance and renew automatically for the same period. You can cancel at any time via the link in your Paddle receipt or at paddle.net; access continues until the end of the paid period and you will not be charged again. We announce price changes at least 30 days before your next period, and you can cancel before it starts.

5. Founders

Accounts created before Plus could be booked keep Plus free for good. Features added later may be reserved for Plus or Perfect Drill.

6. Refunds

You can get a full refund within 30 days of any payment, see the Refund policy. Statutory withdrawal rights remain unaffected.

7. Acceptable use

Do not use Pescaday for anything unlawful, for fraud or spam, to infringe the rights of others (for example by uploading photos that are not yours), or to interfere with security: no malware, no probing or attacks, no automated scraping of content or data.

8. Ownership

The software, texts, graphics and the icon font of Pescaday belong to us. Map and data sources are used under their licences (for example OpenStreetMap, ODbL). Your catches and photos stay yours; if you share a catch you allow us to show it on Pescaday until you remove it.

9. Availability

We do our best, but we cannot promise that Pescaday is always available or free of errors. We may carry out maintenance and change features.

10. Suspension and termination

We may suspend or close an account for a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious violations. If we end a paid subscription without such a reason, we refund the unused part.

11. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. Otherwise we are only liable for breaches of essential obligations, limited to the damage typically foreseeable.

12. Changes to these terms

We announce changes at least 30 days in advance by e-mail or in the app. If you object, you can cancel before they take effect.

13. Law and contact

German law applies; mandatory consumer protection rules of your country of residence remain unaffected. We do not take part in consumer arbitration proceedings and are not obliged to. Questions: hallo@pescaday.com.

Privacy

For payments Paddle receives the details you enter at checkout; we receive only what we need to unlock your tier (Paddle customer and subscription ID, tier, period, status, country, amount, e-mail). Full privacy policy (German): Datenschutz.
