Catch and release: what the law says
Releasing fish under German animal welfare and state fishing law, each state with section and version, plus neighbouring countries and how to release gently.
- No nationwide ban Animal welfare law requires a reasonable cause; courts decide case by case.
- Explicitly banned in Hesse and Saarland. In Thuringia legally caught fish must be killed, in Berlin releasing just for a photo is banned.
- Required everywhere Undersized and protected fish must go back at once, gently.

Federal law and court ruling
Federal law: no one may cause an animal pain, suffering or harm without a reasonable cause (Section 1 sentence 2 of the German Animal Welfare Act, TierSchG). It is a criminal offence, among other things, to kill a vertebrate without a reasonable cause or to cause it prolonged or repeated considerable pain or suffering (Section 17 TierSchG). The Act contains no explicit ban on catch and release, whether deliberately catching and releasing a fish has a reasonable cause is judged case by case. In 2015 the Higher Administrative Court of North Rhine-Westphalia (order of 3 July 2015, file no. 20 B 209/15) upheld an official order against the operator of a fishing pond: if fish are caught after a long fight, presented alive as a trophy and then released, they suffer without a reasonable cause. The court stressed that the order was not directed against angling as such and did not concern protected or undersized fish. State law: Hesse (Section 14 (6) HFischV) and Saarland (Section 10 (1) no. 6 LFO) explicitly ban catch and release, Berlin bans catching and releasing solely to record a fish's size or appearance (Section 9 (3) LFischO). In all 16 states, undersized fish and fish caught in the closed season must still be released (details per state below). Bavaria allows releasing fish of legal size if this serves the stock management goal (Section 11 (8) AVBayFiG). The national anglers' federation DAFV states in its guidelines that fish with a closed season or minimum size are released alive and that fish kept for eating are dispatched properly and used sensibly. The Austrian Animal Welfare Act explicitly does not apply to fishing (Section 3 (4) TSchG). Whether and when fish must or may be released therefore depends on the fisheries law of each federal state and the conditions of the fishing licence, not checked individually here.

In England, any eels caught (except conger eels) must be released alive, and fish you cannot keep must be returned to the water unharmed. On rivers there are daily limits, for example one pike up to 65 cm, two grayling between 30 and 38 cm and 15 small fish up to 20 cm; local byelaws set the limits for salmon and trout. Wales has its own rules (Natural Resources Wales).

Catch and release is widespread in the USA and the federal agency NOAA Fisheries recommends best practices for it (page updated on 4 August 2026). Minimum sizes, slot limits and release duties are set by the states and, for federal waters, by NOAA, and differ by state and species.

How to release a fish gently
- Handle the fish as little as possible and only with wet hands so its protective slime layer is not damaged. source
- Keep the fish in the water where possible and unhook it there; if it has to come out, keep air exposure short, NOAA says under 60 seconds is ideal. source
- Never hold the fish hanging by its lip or mouth, support the whole body and avoid touching eyes and gills. source
- If the hook is swallowed deeply, do not pull, cut the line as close to the hook as possible. In Brandenburg this is required when a fish must be released (cut the line level with the tip of the head, Section 3 (1) BbgFischO). source
- Use barbless, crimped-barb or circle hooks, they make unhooking easier. In Switzerland barbed hooks are generally banned (Art. 23 TSchV). source
- Do not fight a fish to exhaustion; hold a tired fish facing into the current until it swims away on its own. source
Sources as of 2026-10-23. Not legal advice. Club rules and permits can be stricter; if in doubt ask the fisheries authority.
In Germany, closed seasons and minimum sizes are set by each state and can be stricter for single waters. All German rules by state, with the legal source. Outside Germany, the local rules apply: licence and agency by country.
